
MORRISTOWN, N.J. (AP) — An elder rights group is urging a New Jersey judge to enforce a court order and investigate possible criminal conduct in a case alleging the financial exploitation of a 90-year-old stroke survivor.
Elder Help Network filed a motion to appear as amicus curiae in the Superior Court case Kerekes v. Polyak before Civil Presiding Judge Frank DeAngelis. The organization contends that Samuel Polyak of Polykup and David Gutwill of Ultimate Car Care engaged in actions amounting to elder abuse.
Court filings state that Kerekes contracted for a high-end Tesla battery conversion of his 2003 Acura NSX. Instead, authorities were allegedly provided with recalled Chevrolet Bolt batteries, and major original components — including the engine and transmission — valued at roughly $200,000 went missing after the car was returned under a Writ of Replevin, the brief says.
The group is asking the court to order the return or accounting of the missing parts, issue subpoenas for testimony and documentation, and refer the case to prosecutors for potential theft and elder financial exploitation charges.
“Elder Help Network takes allegations of elder abuse seriously,” the filing states.
The matter remains pending, and no trial date has been set. The defendants have not publicly commented on the allegations.
